Beginning at 9:00 a.m. Eastern Time (“ET”) on September 6, 2011 until 5:00 p.m. ET on October 6, 2011 (the “Sweepstakes Entry Period”), you may enter the Scripps Networks, LLC d/b/a Home & Garden Television (“HGTV” or “Main Sponsor”) “Sears’ Handyman Workshop” Sweepstakes (the “Sweepstakes”) online by visiting the HGTV website (www.hgtv.com) (the “HGTV Website”) and completing the online entry form by providing your name, complete address, phone number (including area code) and valid e-mail address (limit one (1) online entry, per valid email address, per eligible person per day). If an entrant uses multiple e-mail addresses to submit more than one online entry for a given day, only the first online entry for that day will be considered valid. These official rules are also available at the HGTV Website. All eligible entries received during the Sweepstakes Entry Period will be entered into the Grand Prize Drawing.
Sears Holdings Management Corporation (“Sears”) is a prize provider in connection with the Sweepstakes. When you enter, you may be asked to consent to receive promotional e-mails and reminders for upcoming Sears promotions and information about Sears. Consenting to receive such e-mails is optional and does not have to be agreed to in order to be eligible to enter the Sweepstakes and does not improve your chances of winning. Sears, and all Participating Sponsors identified below (collectively with Main Sponsor, the “Sweepstakes Entities”), their respective affiliates, subsidiaries, parent corporations, and their respective officers, directors, shareholders, employees and agents, and any and all Internet servers and access provider(s) are not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, server providers, or software, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in this Sweepstakes; inability to access the HGTV Website; theft, tampering, destruction, or unauthorized access to, or alteration of entries; transactions that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or at any Website; printing or human or other errors; and any entries which are late, lost, incomplete, misdirected, stolen, mutilated, illegible, or any combination thereof. This Sweepstakes is open only to legal residents of the U.S. and its territories, possessions and commonwealths who are 18 years of age or older, except employees and members of their households and immediate families (spouses, parents, siblings, children and each of their respective spouses) of Main Sponsor, TEAM Group, LLC (“Sweepstakes Administrator”), Sears, and all other participating sponsors (collectively, the “Participating Sponsors”) and their respective parent companies, subsidiaries, and affiliates, and their advertising and promotion agencies and all local sponsors. Entrants who have won a prize in any Scripps Networks, LLC promotion in the ninety (90) days prior to the commencement of the Sweepstakes are ineligible. Main Sponsor reserves the right to conduct a background check on any potential winner and reserves the right in its sole discretion to disqualify any person based on such background check if Main Sponsor determines in its sole discretion that awarding the Prize to such potential winner might reflect negatively on Main Sponsor or any of the Participating Sponsors. By entering, all participants and/or entrants release the Sweepstakes Entities and their respective parent companies, subsidiaries, and affiliates, and their respective agents, advertising and promotion agencies, affiliated companies, Sweepstakes partners and prize suppliers, and all of their respective affiliated companies, employees, officers, directors and shareholders, from and against all claims and damages arising in connection with each entrant’s participation and/or entry in the Sweepstakes and/or their receipt or use of any prize awarded in this Sweepstakes. Any and all warranties and guarantees are subject to the respective manufacturer’s terms, if applicable. This Sweepstakes is governed by U.S. law and is subject to all federal, state, and local laws and regulations. Void outside the U.S. and where prohibited by law.
The Grand Prize and First Prize Winners (collectively, the “Winners”) will be selected in a random drawing from among all eligible entries on approximately October 17, 2011, by TEAM Group, LLC, an independent judging organization, and will be contacted either in person, by email, or by overnight courier and phone on or about October 19, 2011. Administrator’s decisions with respect to the winners and other matters pertaining to the Sweepstakes shall be final. If Main Sponsor is unable to contact a potential prize winner, if a potential prize winner fails to complete and return all forms by the specified date or if a potential prize winner fails to comply with any of the requirements of the Official Rules, or if any prize or prize notification is returned as undeliverable, an alternate winner shall be selected. Each potential prize winner will be required to sign an affidavit of eligibility and release of liability and publicity, and return same, properly executed, within five (5) days of issuance of prize notification. All documents must be returned by the date and/or time indicated within such documents. If a potential prize winner fails to return such documents within that time, or if an entrant is found to be ineligible, then the potential prize winner will be disqualified and an alternate winner will be selected. Except where prohibited by law, the winner’s entry and acceptance of the prize constitutes permission for the Sweepstakes Entities to use said winner’s, photograph, likeness, statement, biographical information, voice and/or video, and city and state address on a worldwide basis, and in all forms of media including online announcements for advertising and promotional purposes, in perpetuity, without further compensation. The odds of winning depend upon the number of eligible entries received.
Entry materials that have been tampered with or altered are void. If, in the Administrator’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Sweepstakes, Main Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process and void any entries submitted fraudulently, to modify or suspend the Sweepstakes, or to terminate the Sweepstakes and conduct a random drawing to award the Prizes using all eligible, non-suspect entries received as of the termination date. Should the Sweepstakes be terminated prior to the stated expiration date, notice will be posted on the HGTV Website. In the event of a dispute as to the identity of a Winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
One (1) Grand Prize Winner will receive a Sears gift card valued at One Thousand Five Hundred Dollars ($1,500). Total value of Grand Prize: $1,500.
Two (2) First Prize Winners will each receive a Sears gift card valued at Five Hundred Dollars ($500). Total value of all First Prizes: $1,000.
Total ARV of all prizes in this Sweepstakes: $2,500.
All costs, taxes, fees, and expenses associated with any element of any prize not specifically addressed above are the sole responsibility of the respective winner. All federal, state and local taxes on prizes are the respective winner’s responsibility. Grand Prize Winner will be issued a 1099 tax form for the value of the prize awarded. The specifics of all aforementioned elements of any prizes in the Sweepstakes shall be solely determined by Main Sponsor. Some restrictions may apply. Prizes cannot be transferred, substituted or redeemed for cash except at Main Sponsor’s sole discretion. Main Sponsor reserves the right to substitute a prize, or portions thereof, with a prize of equal or greater value. All prizes will be awarded.
Beginning on or about October 24, 2011 you may obtain the names of the prize winners by going to the HGTV Website (www.hgtv.com). Results of the Sweepstakes will be removed from the HGTV Website on or about November 15, 2011.
