HOME & GARDEN TELEVISION – HGTV GREEN HOME GIVEAWAYSM OFFICIAL RULES – NO PURCHASE OR ONLINE ENTRY NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED.
How to Enter: Beginning at 9:00 a.m. Eastern Time ("ET") on March 21, 2008 until 5:00 p.m. ET on May 9, 2008 (the "Sweepstakes Period"), you may enter the Home & Garden Television ("HGTV") - HGTV Green Home GiveawaySM sweepstakes (the "Sweepstakes") in any of the following ways: (i) online, by visiting the HGTV website (www.hgtv.com) (the "HGTV Website") and completing and submitting the online entry form (limit one (1) online entry, per valid email address, per eligible person per day); or (ii) mail, by hand printing your name, complete address, phone number (including area code) and date of birth either on a postcard or on a separate piece of paper no larger than 8½ x 11 inches, and mailing the postcard or paper in an envelope with the proper postage affixed to: "HGTV Green Home Giveaway, PO Box 51622, Knoxville, TN 37950". Entrants using US mail may enter as often as they wish. Mail-in entries must be postmarked by May 9, 2008 and received by May 16, 2008. Limit one (1) entry per stamped envelope. Mechanically reproduced or hand-stamped entries or mailing labels or entries generated by script, macro or other automated or mechanical means will not be accepted. Incorrect, illegible, corrupt, and incomplete entries are void. All eligible entries received will be entered in the Grand Prize Drawing. When you enter at the HGTV Website, you may be asked to consent to receive promotional e-mails and reminders for upcoming HGTV promotions and information about HGTV and the Participating Product Sponsors identified below. Consenting to receive such e-mails is optional and does not have to be agreed to in order to be eligible to enter the Sweepstakes and does not improve your chances of winning. Scripps Networks, LLC d/b/a Home & Garden Television ("Main Sponsor"), and all Participating Product Sponsors identified below (collectively with Main Sponsor, the "Sweepstakes Entities"), Ritway, Inc., and their respective affiliates, subsidiaries, parent corporations, advertising and promotion agencies, all local sponsors, and their respective officers, directors, shareholders, employees and agents, and any and all Internet servers and access provider(s) (collectively, "Released Parties") are not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, server providers, or software, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in this Sweepstakes; inability to access the HGTV Website; theft, tampering, destruction, or unauthorized access to, or alteration of entries; entries that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or at any website; printing, typographical, or human or other errors; and any entries which are late, lost, incomplete, delayed, misdirected, stolen, mutilated, inaccurate, illegible or arrive postage due, or any combination thereof. Proof of mailing, in person submission, or online submission is not considered proof of delivery or receipt. All entries become the property of Main Sponsor and will not be returned. A purchase will not increase chance of winning. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, MAIN SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
Eligibility: This Sweepstakes is open only to legal residents of the U.S. and its territories, possessions and commonwealths (excluding Puerto Rico) who are 21 years of age or older as of March 21, 2008, except employees and members of their households, whether or not related, and immediate families (spouses, parents, siblings, children and each of their respective spouses regardless of where they reside) of Main Sponsor and GMC Division of General Motors Corporation, Shaw Industries, Inc., Sears, Roebuck and Co., Kohler Co., S.C. Johnson & Son, Inc., CaesarStone US, Rechargeable Battery Recycling Corporation (RBRC), Core Communities, LLC, Rinnai, and all other participating product sponsors (collectively, the "Participating Product Sponsors"), Ritway, Inc., and their respective parent companies, subsidiaries, and affiliates, and their advertising and promotion agencies and all local sponsors are not eligible to enter or win the Grand Prize. Main Sponsor reserves the right to conduct a background check on any potential Grand Prize Winner and reserves the right in its sole discretion to disqualify any person based on such background check if Main Sponsor determines in its sole discretion that awarding the prize to such potential Grand Prize Winner might reflect negatively on Main Sponsor or any of the Participating Product Sponsors. By entering, all participants and/or entrants agree to release the Released Parties from and against all claims and damages arising in connection with each entrant’s participation and/or entry in the Sweepstakes and/or his/her receipt or use of any element of the Grand Prize awarded in this Sweepstakes including any injury or harm resulting from the use of the vehicle or any travel or activity related thereto. Any and all warranties and guarantees with respect to any prize element are subject to the respective manufacturer’s terms. This Sweepstakes is governed by U.S. law and is subject to all applicable federal, state and local laws and regulations. Void in Puerto Rico, outside the U.S. and its territories, possessions, and commonwealths and where prohibited by law.
How the Grand Prize Winner will be Determined:
Grand Prize Winner Drawing and Notification: A predetermined number of potential Grand Prize finalists (the "Finalists" and each, a "Finalist") will be chosen by Main Sponsor in a random drawing from among all eligible entries received during the entire Sweepstakes Period on or about May 19, 2008 that will be monitored by Ritway, Inc., an independent judging organization ("Sweepstakes Administrator"). Each of the Finalists will be contacted either by phone, e-mail, in writing or in person on or about May 19, 2008 (subject to change). Finalists may be filmed during such live visit by Main Sponsor. The Finalists will be required to execute an affidavit of eligibility and release of liability and publicity (where permitted by law), and return same, fully-executed, within five (5) days of date of issuance of prize notification. Main Sponsor may require the Finalists to travel at Main Sponsor’s expense to the taping of the televised HGTV Green Home Giveaway special at Main Sponsor’s studios in Knoxville, TN or such other location in the US selected by Main Sponsor for a televised drawing before a studio audience and/or publicity purposes on or about June 7 through 9, 2008 (dates subject to change). All but one (1) Finalist will be eliminated during the live taping of the HGTV Green Home Giveaway winner special, and this one (1) remaining Finalist shall be determined the Grand Prize Winner and will be awarded the Grand Prize. If Main Sponsor is unable to contact any Finalist within five (5) days of the initial attempt, if any Finalist fails to return all requested forms fully-executed by the specified date, or if any Finalist fails to comply with these Official Rules, including traveling on the dates and times required by Main Sponsor, his/her place as a possible Grand Prize Winner will be forfeited at Main Sponsor’s discretion, and an alternate Grand Prize Winner shall be selected. For the avoidance of doubt, if Main Sponsor elects to award the Grand Prize during a televised event as described above Finalist must travel to the location designed by Main Sponsor and on the dates required by Main Sponsor (at Main Sponsor’s expense) to be eligible to win the Grand Prize. Grand Prize Winner may also be required to travel to the HGTV Green Home on "Winner Weekend" (dates TBD) at Main Sponsor’s expense. The date of the Winner Weekend shall be at Main Sponsor’s sole discretion. Main Sponsor reserves the right not to produce or televise the HGTV Green Home Giveaway winner special and to select the winner in a random drawing format that shall be determined by Main Sponsor.
Main Sponsor and Sweepstakes Administrator’s decisions with respect to the Finalists and the Grand Prize Winner and other matters pertaining to the Sweepstakes shall be final and binding. By entering into the Sweepstakes, each entrant consents to the use by Sweepstakes Entities and their designees of his/her name, photograph likeness, biography, voice, performance and/or video (including any footage compiled when the Finalists are contacted) for advertising and promotional purposes including "ambush style" or studio-based on-air camera appearances to announce the Finalists and the Grand Prize Winner in any and all media, including online announcements now or hereafter known, worldwide and without limitation and without additional compensation, notification or permission, except where prohibited by law. In addition, participants in any of HGTV’s on-air presentations will be required to sign any agreements and releases designed by Main Sponsor with respect to their services and performances. Main Sponsor and its designees may exploit, edit, modify, and distribute any footage compiled during the period when the Finalists are contacted, including, without limitation, the names and likenesses of any persons or locations embodied therein, in any and all media now known or not currently known, throughout the world in perpetuity without additional compensation, permission or notification to any Finalist or any third party. The odds of winning the Grand Prize depends upon on the number of eligible entries received for the entire Sweepstakes Period and the number of Finalists.
General Conditions: Main Sponsor and Sweepstakes Administrator’s decisions with respect to the Grand Prize Winner and any other matters pertaining to the Sweepstakes shall be final. By entering into the Sweepstakes, all entrants consent to the use of their name, photograph (including photographs submitted by them to Main Sponsor), likeness, biography, voice and/or video for advertising and promotional purposes, including online announcements, worldwide and without limitation and without additional compensation, except where prohibited by law. The odds of winning depend upon the number of eligible entries received for the applicable drawing.
Entry materials that have been tampered with or altered are void. If, in the Main Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Sweepstakes, the Main Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process and void any entries submitted fraudulently, to modify or suspend the Sweepstakes, or to terminate the Sweepstakes and conduct a random drawing to award the prize using all eligible, non-suspect entries received as of the termination date. Should the Sweepstakes be terminated prior to the stated expiration date, notice will be posted on the HGTV Website. Any attempt by an entrant or any other individual to deliberately damage any website or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws and should such an attempt be made, Main Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. In the event of a dispute as to the identity of the potential Finalists based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Such Authorized account holder will be required to comply with these Official Rules.
Grand Prize: One (1) Grand Prize Winner shall win the Grand Prize consisting of the home located in Tradition Hilton Head, South Carolina (the "HGTV Green Home") that is featured in the "HGTV Green Home" special, plus home furnishings, merchandise, and an automobile. The home is valued at approximately $700,000 (includes structure, lot, and landscaping) as of February 1, 2008. All decisions related to the HGTV Green Home shall be at Main Sponsor’s sole discretion. Actual value of HGTV Green Home depends on market fluctuations. The home furnishings, merchandise, and the automobile consist of: (i) furniture and accessories (Approximate Retail Value "ARV": $100,000.00); and (ii) a 2008 GMC Yukon Hybrid (ARV: $56,045.00). All home furnishings, merchandise, and the automobile will be selected by Main Sponsor at its sole discretion. All home furnishings and merchandise will be delivered to the HGTV Green Home in Tradition Hilton Head, South Carolina. The HGTV Green Home shall be conveyed to the Grand Prize Winner without representations or warranties, express or implied, other than those, if any, provided by the contractor/developer ("Developer") from whom Main Sponsor has agreed to acquire the HGTV Green Home, and other than any applicable manufacturers’ warranties. Real estate transfer taxes, deed recording charges and closing costs, if not the obligation of the Developer pursuant to an agreement with Main Sponsor (the "Home Contract") to acquire the home, shall be the sole responsibility of the Grand Prize Winner, as will all current and future real estate taxes and all other taxes, costs, fees, and expenses related to the maintenance of the house commencing as of the date the Grand Prize Winner accepts the Grand Prize. Title insurance and homeowner’s hazard and liability insurance shall be the sole responsibility of the Grand Prize Winner. The Sweepstakes Entities and/or Released Parties shall not be responsible for construction delays and condition of title to home shall otherwise be as set forth in the Home Contract. For the automobile, the Grand Prize Winner is solely responsible for the taxes, registration, insurance (proof of which must be shown prior to the Grand Prize Winner taking possession of vehicle along with a valid U.S. driver’s license), license, pickup costs at the automobile dealership designated by General Motors Corporation and any other option not included on the stated model. Total ARV of Grand Prize is $856,045. Total ARV of all prizes in this Sweepstakes is $856,045.
General Prize Conditions: All costs, taxes, fees, and expenses associated with a prize or the acceptance and use of any element of a prize not specifically addressed above are the sole responsibility of the respective winners. All federal, state, and local taxes on prize are winner’s responsibility. The Grand Prize Winner will be issued a 1099 tax form for the ARV of the prize. The specifics of all aforementioned elements of any prizes in the Sweepstakes shall be solely determined by Main Sponsor. Some restrictions may apply. Prizes cannot be transferred, substituted or redeemed for cash except at Main Sponsor’s sole discretion. Main Sponsor reserves the right to substitute any prize, or portions thereof, with a prize of comparable or greater value, at its sole discretion. All Grand Prize will be awarded.
Winners’ List: Beginning on or about July 14, 2008 you may obtain the name of the Grand Prize Winner, either by going to the HGTV Website (www.hgtv.com) or mailing a self-addressed stamped envelope to: HGTV Green Home Giveaway - Winners List, PO Box 53552, Knoxville, TN 37950. Requests received after August 18, 2008 will not be honored.
