Host Carol Duvall and lawyer Marlaine McVisk talk with viewer Darcey Toom via telephone to give advice about marketing and selling a new book.
Toom invented a craft kit called Recylca-Card, which includes hand-designed parts of cards and greetings so that the buyer can mix and match to create his or her own cards. Soon, Toom decided to author a book containing several different original card designs, introducing different ways to crop and layer the pieces to create various designs of cards. Also included are card templates that buyers can photocopy to make their own cards.
Since some of the card designs were created by Toom's friend, McVisk suggests that in order to avoid copyright issues, Toom either get personal permission from the friend to use her designs or buy the designs from the friend. Also, some of Toom's original designs were created via a computer graphics program. McVisk suggested she find out what kind of permission the program company gives for use of its fonts.
McVisk says that artists, crafters and designers don't necessarily have to sell all their rights in an image to a purchaser. For example, they can limit the use of the image to geography, type of expression, or even publication rights to a particular book.
