HGTV Design Star Sweepstakes

1. How to Enter: NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE. Beginning at 9:00 a.m. Eastern Time ("ET") on July 17, 2009 until 5:00 p.m. ET on September 15, 2009, you may enter the HGTV Design Star Sweepstakes (the "Sweepstakes") in any of the following ways: (i) online by visiting the HGTV Website (www.hgtv.com) (the "HGTV Website") and completing the online entry form by providing your name, complete address, phone number and valid e-mail address (limit one online entry per person and per e-mail address per day); or (ii) by hand printing your name, complete address and phone number (including area code) either on a postcard or separate piece of paper no larger than 8½" x 11", and mailing the postcard or paper to: "HGTV Design Star Sweepstakes," P.O. Box 51412, Knoxville, TN 37950 (limit one entry per envelope). Mail-in entrants may enter as often as they wish but their entries must be postmarked by September 15, 2009, and received by September 22, 2009. Mechanically reproduced or hand-stamped entries or mailing labels will not be accepted. If an entrant uses multiple e-mail addresses to submit more than one online entry for a given day, only the first online entry for that day will be considered valid. When you enter at the HGTV Website, you may be asked to consent to receive promotional e-mails and reminders for upcoming HGTV promotions and information about HGTV. Consenting to receive such e-mails is optional and does not have to be agreed to in order to be eligible to enter the Sweepstakes and does not improve your chances of winning. In the event you do consent to receive these e-mails, the use of such e-mails shall be subject to the privacy policy of Scripps Networks, LLC, which is available on the HGTV Website. Scripps Networks, LLC d/b/a Home & Garden Television ("Main Sponsor") all other Sweepstakes Entities (as defined below), their affiliates, distributors, dealers, subsidiaries, parent corporations, and their respective officers, directors, shareholders, employees and agents, and any and all Internet servers and access provider(s) are not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, server providers, or software, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Sweepstakes; inability to access the HGTV Website; theft, tampering, destruction, or unauthorized access to, or alteration of entries; transactions that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or at any website; printing or human errors; and any mailed entries which are late, lost, incomplete, misdirected, stolen, mutilated, illegible or postage due, or any combination thereof. Proof of mailing is not considered proof of delivery or receipt. All entries become the property of HGTV and will not be returned or acknowledged.

2. Eligibility: This Sweepstakes is open only to residents of the fifty (50) United States and the District of Columbia (excluding Puerto Rico) who are 18 years of age or older. Entrants who have won a prize in any HGTV or Scripps Networks, LLC promotion in the ninety (90) days prior to the commencement of the Sweepstakes are ineligible. Employees and their immediate families (spouses, parents, siblings, children and each of their respective spouses) of HGTV, Sears Holdings Corporation, Lumber Liquidators, Inc., S.C. Johnson & Son, Inc., MasterCard Incorporated, and other participating sponsors and their respective parent companies, divisions, subsidiaries, affiliates, and their advertising and promotion agencies (collectively, the "Sweepstakes Entities") are not eligible to enter or win. This Sweepstakes is governed by U.S. law and is subject to all federal, state and local laws. Void where prohibited by law.

3. Grand Prize: One (1) Grand Prize Winner will win the following: (i) one (1) $5,000 shopping spree from Sears (awarded as ten (10) gift cards valued at $500 each); (ii) up to $5,000 (inclusive of delivery charges) in hardwood flooring supplied by Lumber Liquidators; and (iii) a one (1) year supply of Pledge Multi-Surface Aerosol: Approximate Retail Value ("ARV"): $107.76 (twenty-four (24) bottles with an ARV of $4.49 per bottle). Total ARV of Grand Prize: $10,107.76.

Gift cards are subject to terms and conditions specified by issuers. The flooring component of the Grand Prize is awarded "as is" with no warranty or guaranty, either express or implied, except the manufacturer's written warranty, if any, provided for the subject flooring. When replacing and/or installing the floor, the Grand Prize Winner is advised to obtain the services of a qualified, licensed and insured architect and/or contractor to perform the work. The Sweepstakes Entities will not be responsible for any architectural design, permitting, licensing, construction, or other related services required to install the flooring and will not be a party to any contracts relating to such services. The Grand Prize will be awarded directly to the Grand Prize Winner. No payments, products or services will be made to third parties. The Sweepstakes Entities shall not be responsible for any design or construction defects, any merchandise or product defects, or any zoning or building code violations arising as a result of use or installation of the flooring and/or renovating the Grand Prize Winner's home. All additional costs, taxes, fees, and expenses associated with any element of any prize not specifically addressed above are the sole responsibility of the Grand Prize Winner. All federal, state and local taxes on prizes are Grand Prize Winner's responsibility. Winner will be issued a 1099 tax form for the ARV of the prize. The specifics of all aforementioned elements of any prizes in the Sweepstakes shall be solely determined by Main Sponsor. Some restrictions may apply. The Grand Prize cannot be transferred, substituted or redeemed for cash except at Main Sponsor's sole discretion. Main Sponsor reserves the right to substitute a prize, or portions thereof, with a prize of equal or greater value.

4. Drawing and Notification: The Grand Prize Winner will be selected in a random drawing from among all eligible entries on or about October 1, 2009 by Ritway, Inc., an independent judging organization ("Sweepstakes Administrator") and will be contacted by overnight courier and/or by phone on or about October 6, 2009. If the potential Grand Prize Winner cannot be reached within five (5) days from the first notification attempt, then such potential winner will be disqualified and an alternate winner will be selected. Acceptance of prize must be confirmed within twenty-four (24) hours from the time personal contact is made with the potential winner, otherwise potential winner will be disqualified and an alternate winner will be selected. The name of the Grand Prize Winner may be posted on the HGTV Website. Main Sponsor and Sweepstakes Administrator's decisions with respect to the winner and other matters pertaining to the Sweepstakes shall be final. Potential Grand Prize Winner will be required to sign an affidavit of eligibility and release of liability and publicity, and return same, properly executed, within five (5) days of issuance of prize notification. If HGTV is unable to contact a potential Grand Prize Winner, and/or if the potential Grand Prize fails to complete and return all forms by the specified date and/or if potential Grand Prize Winner fails to comply with any of the requirements, or if any prize or prize notification is returned as undeliverable, an alternate winner(s) shall be selected. Grand Prize Winner consents to the use of his/her name, photograph, likeness, biography, voice and/or video for advertising and promotional purposes, including online announcements, without additional compensation, except where prohibited by law. The odds of winning depend upon the number of eligible entries received. Entry materials that have been tampered with or altered are void. If, in the Main Sponsor's opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Sweepstakes, the judges reserve the right at their sole discretion to disqualify any individual who tampers with the entry process and void any entries submitted fraudulently, to modify or suspend the Sweepstakes, or to terminate the Sweepstakes and conduct a random drawing to award the prizes using all eligible, non-suspect entries received as of the termination date. Should the Sweepstakes be terminated prior to the stated expiration date, notice will be posted on the Website. In the event of a dispute as to the identity of the winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY'S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

5. Release of Liability: Main Sponsor, its respective affiliates, subsidiaries, parent corporation, each of the Sweepstakes Entities, and the respective officers, directors, shareholders, dealers, distributors, employees and agents of the Sweepstakes Entities, and are not responsible for: any incorrect or inaccurate entry information, human error, technical malfunctions, theft, tampering, destruction, or unauthorized access to, or alteration of entries. By entering this Sweepstakes, all entrants, any winners, and their family members, guests, invitees, agents, and employees release and hold harmless Main Sponsor and each of the Sweepstakes Entities, as well as the respective officers, directors, agents, employees and shareholders of the foregoing entities and all others associated with the development and execution of this Sweepstakes from and against any and all actions, claims, and/or liability with respect to or in any way arising from participation in this Sweepstakes and/or acceptance or use of the prizes and any related travel and/or activities, including liability for personal injury, death, damages, or loss. Any and all warranties and/or guarantees on a prize (if any) are subject to the manufacturer's terms therefor, and winner agrees to look solely to such manufacturer for any such warranty and/or guarantee.

6. Winner's List: After October 9, 2009, you may obtain the name of the Grand Prize Winner, either by visiting the HGTV Website or mailing a SASE to: "HGTV Design Star Sweepstakes" — Winner's List, P.O. Box 51573, Knoxville, TN 37950. Requests received after October 30, 2009, will not be honored.
